If the typical morning or afternoon court calendar has 40 to 60 cases, simple math demonstrates how little time a judge or district attorney has to devote to each case and highlights the importance of a succinct, organized and persuasive presentation.

Working the Math: If a morning court session has 40 cases for 2 hours and 45 minutes (165 minutes), a judge only can devote an average of under five minutes for each case, to hear the facts of the case from each side’s perspective, determine what the facts actually are, make a proposal involving potential punishment to each side, discuss each side’s issues about the punishment and impose the sentence.

Of course, some cases will take longer or shorter than others for a variety of reasons. But the math illustrates the importance of how heavy case loads can affect the manner in which judges review a case and determine punishment.  The attorney must be prepared to present in this relatively short time a succinct yet powerful presentation to the judge and district attorney.

What are potential DUI penalties?

They depend in great part on the nature of the DUI (first, second, third, fourth offense), the type of offense (misdemeanor or felony), the facts of the offense and the driver’s record.

Potential punishments include

  • Jail up to six months for a first offense and up to one year for a second or third offense misdemeanor DUI and up to three years or more for a felony DUI
  • Fines of $2000 or more
  • Probation of three years to five years
  • Formal probation (with a probation officer)
  • DUI classes of six weeks or three, six, nine eighteen or even thirty months in length, depending on the type of DUI
  • Installation of an interlock device for periods of six months to three years
  • Payment of damages
  • Suspension and/or restriction of driving privileges
